Call to Order

 

Ray Knapp called the meeting of the Town of Troy Planning Commission to order at 7:00 p.m.

 

AGENDA: 

1.       Approve Minutes; 

2.       Discuss subdivision screening guidelines;

3.       Discuss State Attorney General’s opinion on Riverway Zoning Ordinance questions;

4.       Discuss & review River Falls ETZ map;

5.       Building Permits/Utility Permits;

1.             Approve Minutes;

             

             Minutes of the June 4, 2009 Plan Commission were reviewed.

       

             Jan Cuccia moved to approve the minutes of the June 4, 2009 Plan

             Commission.  Mark Mitchell seconded. Motion passed, all in favor.

 

             Ray stated that both he and Jan Cuccia would not be able to attend the next PC meeting

             scheduled for August 6, 2009. He asked the PC members present if they would be agreeable to changing

             the meeting to Wed., August 5, 2009. All present agreed. Ray asked that Sharon and Shari be

             notified of the date change due to conflicts with the Chair and Vice-Chair’s schedules.

 

2.            Discuss subdivision screening guidelines;

 

             Mark Mitchell and Ray Knapp worked together on this. Their recommendations were put into a hand-out

             which was received by the PC members. Jan Cuccia asked for clarification that these were guidelines, and

             not an ordinance-which was affirmed by Ray and Mark. Mark went over the guidelines, with discussion

             between the PC members as to wording and clarification. Mark made note of all changes agreed upon by

             the PC members and will make those changes. Jan suggested that the guidelines, when finished, be put

             into a pamphlet form to be given out to developers when they first start the application process.

 

 

 

3.          Discuss State Attorney General’s opinion on Riverway Zoning Ordinance questions;

 

Ray provided the members of the PC with a Rough Draft of a letter he has written to Mr. Matthew Frank, Secretary, WI DNR regarding the Legal Opinions regarding ss.30.27 and NR 118 set forth by the WI Attorney General. Ray then read the letter

 

Jan stated that the Attorney General’s opinion was an informal one, and that the letter should state this.

 

Ray asked  the PC’s opinion on whether a letter should be sent to Mr. Frank of the DNR. The consensus was that it was a good idea to aid in keeping the lines of communication open.

 

Jan asked about the Attorney General’s Opinion, questioning who’s Riverway Ordinance is more restrictive, the County’s or the Town’s, and who determines when there is a conflict between ordinances which one is to be followed? Ray pointed out that in past cases there were times when the County and the Town had very different opinions on what was acceptable and allowable under the dual Riverway Ordinances. Occasionally the County has been more restrictive in interpretation and occasionally the Town has been more restrictive. Everyone agreed that this is the root cause of applicant frustration.

 

 4.        Discuss & review River Falls ETZ map;

 

            Ray read the letter written June 24, 2009 received from Tony Steiner, Planner for the City of River Falls,

            concerning the Reformatting of the Extraterritorial Zoning Map. The members of the PC agreed that they

            appreciated the communication from the City of River Falls, but did not feel that it was the town’s role to

            verify that the boundaries set forth in that communication are correct.

           

5.         Building Permits/Utility Permits;

         

            The Plan Commission reviewed the Building Permits.

 

            There were three utility permits. The Plan Commission reviewed the permits.

             Jan Cuccia moved that the PC recommend  the Town Board approve the utility permits, numbered

            U09-003, U09-004, and U09-005 contingent that the application fees have been received by the

            Town. Joe Duerre seconded. All in Favor. The motion passed.

6.          Committee Reports & correspondence;

 

             Jan Cuccia reported that she was able to attend the Saint Croix Riverway workshop, which included a

             boat ride on the St. Croix River to look at scenic riverway issues on both the WI and MN sides.

             Bob Rolle also attended. There were approximately 100 people who attended, consisting mainly

            of MN and WI county officials. She thought it was very interesting and informative. She brought copies of

            some of the information that she received to share with the members of the Plan Commission.

          

            Ray pointed out that the summer road construction has begun on Townsvalley and Tower roads.

 

7.          Adjourn;

 

Jan Cuccia moved to adjourn. Joe Duerre seconded. All in favor.  Motion passed, meeting adjourned at 8:35 PM.
