ARTICLE I

Glover Park

[Adopted 6-8-1992 by Ord. No. 92-2, as amended through 5-8-2000]

§ 109-1.  Purpose and definitions. 

A.     In order to protect the parks, parkways and recreational facilities within the Town of Troy from injury, damage or desecration, this article is enacted. 

B.      As used in this article, the following terms shall have the meanings indicated: 

PARK — Includes all grounds, structures and watercourses which are or may be located within any area dedicated to the public for use as a park, parkway or recreational facility in the Town of Troy.  

PERSON — Includes any individual, group, firm, organization, partnership or corporation.    

§ 109-2.  Specific regulations. 

A.     Park hours. Glover Park shall be open from 8:00 a.m. to 1/2 hour after sunset daily. Gates will be locked from sunset to 8:00 a.m. No person shall enter or remain in the park at any time other than as herein provided, unless specific written authorization is first obtained from the Park Board or unless the person is involved in an activity that has been previously sanctioned in writing by the Park Board. The park is closed weekdays in the winter. Seasonal opening and closing is determined by the Park Board dependent on weather conditions. 

B.      Alcoholic beverages. It shall be unlawful for any person to drink or have in her/his possession any fermented malt beverage or intoxicating liquor in Glover Park. 

C.     Dumping. No person shall dump or deposit any rubbish, refuse, earth or other material in the park. 

D.     Sound devices. No person shall operate or play any amplifying system until specific written authority is first obtained from the Park Board. 

E.      Pets. No person shall permit any dog, cat or other pet owned by her/him to foul or run at large in the park. Owners are responsible for cleanup after pets. 

F.      Bill posting. No person shall post, paste, fasten, paint or attach any placard, bill, notice, sign or advertising matter upon any structure, tree or other natural object in the park, except park regulations and other signs authorized by the Park Board. 

G.     Model airplanes. The flying of gas-powered remote-control model airplanes is not allowed. 

H.     Firearms, fireworks, bows and arrows. No person shall carry, shoot, fire or discharge any gun, pistol, rocket, bow and arrow, or paint ball guns. The word “gun” shall include any device which will propel projectiles. 

I.       Golf; hardball. No person shall strike a golf ball or throw or bat a hardball in the park. 

J.       Moving of park equipment. No person shall remove benches, bleachers, seats, tables, trash containers or other park equipment from the park unless prior approval of the Park Board is obtained. 

K.     Camping. No camping shall be permitted in the park, except where written prior approval of the Park Board is first obtained. 

L.      Making of fires. No person shall start, tend or maintain a fire except in personal grills or designated Department of Natural Resources approved fireplaces. Personal grills shall be used only in picnic areas. The use of personal grills is permitted, provided that lawns and vegetation are not endangered. Unburned fuel and ashes shall be disposed of in receptacles provided, so as to prevent fire or damage to any park property. 

M.     Interference with permittee. No person shall in any manner harass, disturb or interfere with persons holding written permits granted by the Town of Troy for the use of parks, shelter areas or park facilities. 

N.     Motor vehicles. Motor vehicles shall not be allowed in the park except on specified roadways and parking areas without written permission from the Town. The term “motor vehicle” shall include any power-driven vehicle, such as motorcycles, minibikes, snowmobiles, automobiles, etc. No all-terrain vehicles or snowmobiles are allowed in the park. 

O.     Traffic rules. No vehicle shall be driven more than 15 miles per hour on any park road. 

P.      Vegetation and wildlife. No person shall pick or otherwise destroy native plants or disturb or harass wildlife dwelling in the park. 

Q.     Defacing park property. No person shall intentionally cut, break any kind of glass, break, or in any way injure or deface any building, fence, lamp, equipment or facility or any feature of property, including natural objects, upon or within the park. 

R.      Littering. No person shall throw, deposit, place or leave in the park any paper, rubbish, waste cans, broken glass, bottles or refuse of any kind except in receptacles therein provided for waste. 

S.      Horses, llamas or other domesticated animals. Horses, llamas or other domesticated animals used for riding or pulling will not be allowed in the park. 

T.      Town approval. When Town approval or permission in writing is required, the proper Town authority will authorize the same and inform the Town Clerk-Treasurer.   

§ 109-3.  Posted regulations.

In addition to the regulations herein contained and provided, the Park Board may post from time to time, with Town Board approval, specific rules and regulations, and such specific rules and regulations when posted by the authority of the Park Board shall be incorporated by reference into this article as fully as if set forth herein. 

§ 109-4.  Violations and penalties.

In addition to any other applicable penalty provided by law, any person who shall violate any provision of this article shall, upon conviction of such violation, be subject to a forfeiture as provided in Chapter 39, Citations, of this Code, plus prosecution costs. Upon default, a party can be imprisoned in the county jail for not more than 30 days or until forfeitures are paid. 

A.     In addition to any penalty imposed for violation of this article, any person who shall cause physical damage to or destroy any public property shall be liable for the costs of replacing or repairing such damaged or destroyed property. The parent or parents of an unemancipated minor child may be held liable for the costs of replacing or repairing such damaged or destroyed property in accordance with § 895.035, Wis. Stats. 

B.      Parking violations will be assessed penalties as follows: 

(1)    For any vehicle parked in an area designated “no parking” on park property, for a first offense, as provided in Chapter 39, Citations, of this Code. 

(2)    For subsequent parking violations, for parking in areas marked “Towing Zone,” or for parking which obstructs the passage of emergency vehicles or egress of previously parked vehicles or which otherwise is a threat to public safety, vehicles shall be towed at the owner's expense, including storage fees, in addition to the fine and costs.
